44-year-old arrested on sex charges

Man allegedly sent naked pictures to Auburn teen

Auburn police arrested a 44-year-old man Friday for sending naked pictures to an Auburn teen. Pine Grove resident Charles Wayne Burghy, 44, allegedly got the 16-year-old boy’s phone number on a sales/social-networking site, according to Capt. John Ruffcorn. Burghy allegedly began texting the boy, whose parent alerted Officer Ian Ackard Thursday, Ruffcorn said. Thursday and Friday police continued to text Burghy, who sent naked pictures of himself in reply, according to Ruffcorn. “He basically solicited sexual acts, sent naked pictures of himself via the texts,” Ruffcorn said Friday morning before the arrest. Police set up a meeting with Burghy. He was instructed to buy alcohol in the Auburn shopping center and bring some condoms, Ruffcorn said. Police conducted a sting Friday afternoon that the Journal witnessed. Burghy arrived in the Auburn retail center at 12 p.m. and hesitated outside his dark silver Mazda 3 before going into the store. He immediately walked back out and got in his car. After sitting in and standing outside his vehicle, he strolled quickly into the store and purchased alcohol. Police posing as the teen through text messaging set up a meeting at the Elmwood Motel on Elm Avenue, according to Ruffcorn. Burghy drove out of the retail parking lot. He made his way to Elm Avenue and drove around the back of the Auburn Town Center, turned around and came back to Elm Avenue. He pulled back onto Grass Valley Highway as police pursued him. For several moments it appeared Burghy was going to lead police on a high-speed chase down Grass Valley Highway. At 12:30 p.m., seven officers and investigators pulled Burghy over in the original retail parking lot. Officers drew their guns, forced Burghy onto the ground and took him into custody. During the arrest Burghy said he was confused and that he had never been arrested before. He was smiling as police pulled him away from his vehicle and leaned him up against a police car. Officers pulled the alcohol and store receipt from his car. Burghy was also in possession of the condoms, which he brought with him to Auburn, Ruffcorn said. Burghy is being charged with sending harmful matter with the intent of seducing a minor and contacting a minor with the intent of committing a sexual offense, both felonies. He is also being charged with a misdemeanor of employment or use of a minor to perform prohibited acts. Ruffcorn said parents should always try to be aware of what websites their children are visiting and who they are texting/talking to. “One of the byproducts of living in the technology age we live in is predators like this have a way to contact our children,” Ruffcorn said.
